1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “User,” or “you”) and Stache Guard Grooming Co. (“Stache Guard,” “we,” “us,” or “our”), governing your access to and use of our website, online store, and any related services, products, or digital materials (collectively, the “Services”).

By accessing or using the Services, purchasing any product from Stache Guard, or engaging with our digital platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree, you must not access or use our Services.

2. Eligibility

By using our Services, you represent and warrant that you are at least the age of majority in your province, state, or jurisdiction of residence, or that you are using the Services under the supervision and consent of a legal guardian. You also represent that all information provided is accurate, current, and complete.

3. Products and Use

Stache Guard manufactures and sells handcrafted mustache wax and related grooming products designed for cosmetic use.
All products are made in small batches using natural ingredients. Due to the handcrafted nature of our items, slight variations in texture, scent, or appearance may occur.

3.1 Intended Use

Our products are intended solely for external use. Do not ingest, and avoid contact with eyes or mucous membranes. Keep out of reach of children and pets.

3.2 Allergy and Sensitivity Disclaimer

We recommend conducting a patch test before initial use. Stache Guard shall not be held liable for allergic reactions, skin irritations, or other adverse effects resulting from product use, misuse, or disregard of ingredient information.

3.3 Product Claims

While our formulations are designed with high-quality ingredients, Stache Guard makes no guarantees regarding individual outcomes or hair growth results. Statements regarding product performance have not been evaluated by Health Canada or the U.S. Food and Drug Administration and are not intended to diagnose, treat, or cure any medical condition.

4. Orders and Payment

All orders are subject to acceptance and availability. Stache Guard reserves the right to cancel or refuse any order at our discretion.

4.1 Pricing and Currency

All prices are listed in Canadian dollars (CAD) unless otherwise specified. Prices may change without notice. Taxes and shipping costs will be calculated at checkout.

4.2 Payment Processing

Payments are processed securely through third-party payment gateways. Stache Guard does not store or have access to your full payment information. By submitting payment details, you represent that you have the legal right to use the payment method provided.

4.3 Order Confirmation

Once an order is placed, you will receive an email confirmation. This does not constitute acceptance of the order; acceptance occurs only when your order has been processed and shipped.

5. Shipping and Delivery

Stache Guard ships orders within the estimated timeframes specified at checkout. Shipping timelines are estimates only and are not guaranteed.

We are not responsible for:

  • Delays caused by postal carriers or customs processing.

  • Lost, stolen, or damaged packages after shipment confirmation.

  • Incorrect or incomplete shipping information provided by the customer.

If a package is returned due to incorrect address information, the customer will be responsible for reshipping fees.

6. Returns, Exchanges, and Refunds

Due to the personal nature of grooming and cosmetic products, all sales are final.

Exceptions are made only in the following cases:

  • Products received are defective, damaged upon arrival, or incorrect.

  • The customer contacts Stache Guard within 7 calendar days of delivery, providing order details and photographic evidence.

Approved replacements or refunds are issued at Stache Guard’s sole discretion. Return shipping for defective or incorrect products may be covered by Stache Guard.

7. Intellectual Property Rights

All intellectual property, including but not limited to logos, trademarks, designs, text, images, product formulations, and digital content, are the exclusive property of Stache Guard Grooming Co. and are protected under applicable copyright and trademark laws.

No user may copy, reproduce, distribute, modify, or use Stache Guard’s intellectual property for commercial purposes without express written permission.

8. User Conduct

When accessing or using our Services, you agree not to:

  • Engage in unlawful, fraudulent, or abusive behavior.

  • Upload or transmit malicious code, spam, or harmful content.

  • Interfere with or disrupt the functionality of our website or Services.

  • Use our trademarks, branding, or materials without authorization.

We reserve the right to suspend or terminate user access to our Services for violations of these Terms.

9. Disclaimer of Warranties

All Stache Guard products and services are provided “as is” and “as available” without any warranties of any kind, express or implied.
We disclaim all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Services will be uninterrupted or error-free;

  • Defects will be corrected; or

  • Any content, data, or information is accurate, reliable, or current.

10. Limitation of Liability

To the fullest extent permitted by law, Stache Guard Grooming Co., its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Use or misuse of our products;

  • Inaccurate product information;

  • Inability to access our Services;

  • Any damages arising from allergic reactions, personal injury, or loss of profits or data.

Your sole and exclusive remedy for dissatisfaction with our Services is to discontinue use.

11. Indemnification

You agree to indemnify, defend, and hold harmless Stache Guard Grooming Co., its affiliates, employees, and agents from any claims, damages, or expenses (including legal fees) arising from:

  • Your breach of these Terms;

  • Your misuse of our Services or products;

  • Your violation of any law or third-party rights.

12. Privacy and Data Handling

Stache Guard values your privacy and handles all personal information in accordance with our Privacy Policy, which forms part of these Terms.
We do not sell or share your personal information except as required to process orders or comply with legal obligations.

13. Modifications to Terms

Stache Guard reserves the right to update, modify, or replace these Terms at any time, at our sole discretion. Updates will take effect immediately upon posting to our website. Continued use of the Services after such changes constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms and any disputes arising from or related to the use of our Services shall be governed by and construed in accordance with the laws of the Province of Alberta, and the laws of Canada applicable therein.
You agree to submit to the exclusive jurisdiction of the courts located in that province for resolution of any disputes.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices published by Stache Guard, constitute the entire agreement between you and Stache Guard Grooming Co. regarding your use of our Services and supersede any prior agreements or understandings.
